Welcome to HomeMovers (homemovers.co.ke). These Terms of Service ("Terms") govern your access to and use of our website, services, and any related content (collectively, the "Services") provided by HomeMovers, a moving and relocation company operating in Kenya.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Use of Our Website and Services
You may use our website to request quotes, submit inquiries, and book moving services. You agree to provide accurate, current, and complete information during any registration or quote request process.
You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.
2. Booking and Moving Services
All moving services are subject to a separate service agreement (quotation/confirmation) provided at the time of booking. The following general terms apply:
2.1 Quotations & Pricing
Quotes are estimates based on information provided and a visual survey (if conducted). Final charges may vary due to changes in volume, access issues, additional services, delays, or unforeseen circumstances. Additional charges will be clearly communicated.
2.2 Payment Terms
A deposit may be required to secure your booking. The balance is due on or before completion of the move unless otherwise agreed in writing. We accept bank transfers, mobile money (M-Pesa), and cash. Late payments may incur interest or cancellation of services.
2.3 Cancellation & Rescheduling
Cancellations or rescheduling require at least 72 hours' notice (weekdays) or 96 hours (weekends/public holidays) to avoid fees. Late cancellations may incur charges up to 50-100% of the quoted amount depending on timing and preparation already undertaken.
2.4 Liability & Insurance
We provide basic liability coverage for loss or damage caused by our negligence (subject to limits per item and overall). High-value or fragile items should be declared and may require additional insurance. We are not liable for pre-existing damage, inherent defects, or loss/damage due to force majeure, improper packing by customer, or items not properly prepared.
Claims must be reported in writing within 7 days of delivery (visible damage) or 30 days (concealed damage).
2.5 Customer Responsibilities
- Provide safe access, parking, and working conditions for our team
- Ensure all items are properly packed (or use our packing service)
- Disconnect appliances/utilities where required
- Declare any hazardous, perishable, or prohibited items
3. Intellectual Property
All content on our website (text, images, logos, designs) is owned by HomeMovers or licensed to us and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.
4. Limitation of Liability
To the maximum extent permitted by law, HomeMovers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
5. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms or our services shall be resolved through negotiation, failing which, by arbitration in Nairobi under the rules of the Chartered Institute of Arbitrators (Kenya Branch), or by the competent courts of Kenya.
6. Changes to Terms
We may update these Terms from time to time. Continued use of our Services after changes constitutes acceptance of the revised Terms.
